Who can report a violation?
Individuals who have obtained information about violations in a work-related context, including:
- employee;
- job applicant;
- temporary worker;
- person performing work on a basis other than an employment relationship, including under a civil law contract;
- entrepreneur;
- proxy;
- shareholder or partner;
- person performing work under the supervision and direction of a contractor, subcontractor, or supplier;
- intern;
- volunteer;
- trainee;
- client/contractor;
- supplier.
What can the reported violation concern?
Acts or omissions that are unlawful or intended to circumvent the law, concerning:
- labor law;
- corruption;
- public procurement;
- financial services, products, and markets;
- prevention of money laundering and terrorist financing;
- product safety and compliance;
- transport safety;
- environmental protection;
- radiological protection and nuclear safety;
- food and feed safety;
- animal health and welfare;
- public health;
- consumer protection;
- privacy and personal data protection;
- security of networks and information systems;
- financial interests of the State Treasury of the Republic of Poland, local government units, and the European Union;
- the internal market of the European Union, including public competition and state aid rules, and corporate taxation;
- constitutional freedoms and human and civil rights – occurring in relations between individuals and public authorities and not related to the areas indicated in points 1–17.
Who will receive whistleblower status?
An individual who:
- disclosed information about a legal violation obtained in a work-related context through internal or external reporting;
- had reasonable grounds to believe that the information about the violations reported was true at the time of reporting and that such information falls within the scope of the report.
RADEX POLAND Sp. z o.o. has established and implemented internal channels for receiving and handling reports concerning legal violations:
- Procedure for violations and whistleblower protection for RADEX POLAND Sp. z o.o.
The reporting system operates based on the provisions of Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of Union law. Currently, there are no detailed provisions implementing the above directive into the legal system in Poland.
Reports can be made through (examples provided – not all need to be listed):
- electronically via the Whistlelink.com platform in written form by completing the dedicated reporting form; https://radex.whistlelink.com
- by mail addressed to the legal violations specialist at RADEX POLAND Sp. z o.o., ul. Przemysłowa 3, 14-200 Iława, with the note "Legal violation report – for the attention of the Legal Violations Specialist"
